ALPHA SOFTWARE NOTICE

Anther is pre-release software. By using Anther, you acknowledge that all interactions, including voice recordings, text, and usage data, will be collected and analyzed to develop and improve the Service. Your participation helps shape the future of Anther.

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MahaSangha LLC, a New Mexico limited liability company ("MahaSangha," "Company," "we," "us," or "our"), governing your access to and use of the Anther application, website, and related services (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SERVICE.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of the revised Terms.

2. ELIGIBILITY

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you have the legal capacity to enter into this agreement.

3. ALPHA SOFTWARE; DATA COLLECTION

3.1 Pre-Release Status

The Service is currently in alpha development ("Alpha"). Alpha software is incomplete, experimental, and subject to significant changes. Features may be added, modified, or removed without notice. The Service may contain bugs, errors, and security vulnerabilities.

3.2 Comprehensive Data Collection

During the Alpha period, and as a condition of your use of the Service, you expressly consent to the collection, storage, processing, and analysis of all data generated through your use of the Service, including but not limited to:

  1. Voice recordings and audio data
  2. Transcriptions of voice interactions
  3. Text messages and communications
  4. AI-generated responses
  5. Call metadata, logs, and recordings
  6. Usage patterns and behavioral analytics
  7. Device information and technical diagnostics
  8. Location data (if enabled)
  9. Error reports and crash logs

3.3 Purpose of Collection

Data collected during Alpha will be used to:

  1. Develop, test, and improve the Service
  2. Train and enhance artificial intelligence models
  3. Identify and resolve bugs and technical issues
  4. Analyze user behavior to improve user experience
  5. Conduct internal research and development

3.4 No Expectation of Privacy During Alpha

YOU ACKNOWLEDGE AND AGREE THAT DURING THE ALPHA PERIOD, YOU HAVE NO EXPECTATION OF PRIVACY WITH RESPECT TO ANY DATA OR CONTENT TRANSMITTED THROUGH OR GENERATED BY THE SERVICE. All interactions may be reviewed by MahaSangha personnel for quality assurance and development purposes.

4. USER ACCOUNTS

4.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, without notice or liability.

5. ACCEPTABLE USE

You agree not to use the Service to:

  1. Violate any applicable law, regulation, or third-party rights
  2. Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  3. Impersonate any person or entity or misrepresent your affiliation
  4. Interfere with or disrupt the Service or servers or networks connected to the Service
  5. Attempt to gain unauthorized access to any portion of the Service
  6. Use the Service for any commercial purpose without our prior written consent
  7. Reverse engineer, decompile, or disassemble any portion of the Service
  8. Use automated means to access the Service without our permission
  9. Harvest or collect information about other users

6. INTELLECTUAL PROPERTY

6.1 Our Rights

The Service and its entire contents, features, and functionality, including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof, are owned by MahaSangha, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

6.3 User Content

By submitting, posting, or transmitting any content through the Service, you grant MahaSangha a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media for the purposes described in Section 3.3.

7. THIRD-PARTY SERVICES

The Service may integrate with or rely upon third-party services, including but not limited to Firebase (authentication), OpenAI (artificial intelligence), and Matrix (communications). Your use of such third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.

YOU ACKNOWLEDGE THAT THE SERVICE IS ALPHA SOFTWARE AND MAY CONTAIN SERIOUS DEFECTS. YOU USE THE SERVICE AT YOUR OWN RISK.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAHASANGHA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  3. ANY CONTENT OBTAINED FROM THE SERVICE
  4. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MahaSangha and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any claim that your content caused damage to a third party.

11. DISPUTE RESOLUTION

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.

11.2 Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Albuquerque, New Mexico. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

12. GENERAL PROVISIONS

12.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MahaSangha regarding the Service and supersede all prior agreements and understandings.

12.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
